Throughout these Terms and Conditions, the terms “I”, “me”, or “my” refer to Tom Zawadzki, the sole owner and operator of this site. The terms “you” or “customer” refer to any visitor, user, or person purchasing from the site. By accessing or using my website and/or purchasing something from me, you engage in my “Service” and agree to be bound by the following terms and conditions (“Terms”). These Terms apply to all users of the site.

Please read these Terms and Conditions carefully before using the website or placing an order. If you do not agree to all the terms and conditions stated here, you should not use this website. I am a small independent artist and seller, so I’ve written these terms in a straightforward way. They outline what you can expect from me and what I expect from you when we enter into a sale contract. If you have any questions about these terms, feel free to contact me.

About My Business: I operate as an individual sole trader. When you purchase a print, you are buying directly from me, the artist. All prints are my original photography works. I partner with a professional lab for fulfilling many orders, but all pricing, policies, and customer service are handled by me personally.

1. Use of the Website

By accessing tomzawadzki.com, you confirm that you are at least 18 years old, or if you are under 18, that you have received permission from a parent or legal guardian to use the site and make purchases. You agree to use this website only for its intended purpose – browsing and purchasing art in a lawful manner.

You must not misuse the website. This includes prohibitions on: committing or encouraging a criminal offense; transmitting any malicious or harmful code (viruses, trojans, worms); hacking into any part of the service; or infringing upon any person’s proprietary rights. Any breach of these prohibitions may result in termination of your access to the site and could also expose you to legal liabilities.

The content on this site (including all photographs, images, text, design) is owned by or licensed to me. It is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or otherwise use any content from this site without my explicit written permission, except as necessary for personal viewing of the site or purchasing process. For clarity: buying a print from me does not give you the right to reproduce that image for commercial purposes; it grants you ownership of that physical print or artwork, but I retain the copyright to the image itself.

2. Product Information

I endeavor to describe and display my artworks as accurately as possible on the website. This includes information about sizing, paper type, finishes, limited edition details, etc. However, please note that the colors and appearance of prints on your screen may differ slightly from the actual product. This is because different monitors or devices have varying color settings. I assure you that all prints are produced to professional standards, and I take care that the final product is true to my artistic intent.

All product prices, details, and availability are subject to change at any time at my discretion. I reserve the right to discontinue any image or product. If a product you are interested in is listed as out of stock or otherwise unavailable, you can contact me to inquire – sometimes it may be a temporary issue or I can suggest an alternative.

3. Pricing & Payment

  • Currency: All prices on the site are listed in Great British Pounds (GBP £). If you are purchasing from outside the UK, your payment provider will handle the currency conversion to GBP (which may result in a slight difference in the final charge depending on exchange rates or fees set by your bank).

  • Pricing Accuracy: I make every effort to ensure that the prices displayed are correct. In the unlikely event that there is a pricing error (for example, an artwork is mistakenly listed at an obviously incorrect price), I reserve the right to cancel any orders placed at that incorrect price. If this happens, I will inform you and of course provide a full refund. I am not obligated to provide a product at an incorrect price, even after an order confirmation, if the pricing error is obvious and unmistakable (e.g., a £150 print listed for £15 due to a typo).

  • Payment Methods: I accept major credit and debit cards through a secure checkout (Visa, MasterCard, Apple Pay, Google Pay). All payments are processed via secure, trusted payment gateways. When you place an order, you will be required to provide payment details. By providing your payment information, you represent that you are authorized to use the payment method and you authorize the charge for your order. Payment is captured at the time of order (in other words, your card will be charged when you confirm the purchase, not when I ship the item).

  • Taxes: Currently, as a small UK sole trader, I am not VAT registered (meaning I do not add VAT to my product prices). The price you see is the price you pay (plus shipping). If this status changes in future (for instance, if my volume increases and I have to register for VAT), I will update pricing or clearly indicate taxes. For international orders, as noted in the Shipping Policy, you are responsible for any import taxes or duties upon delivery in your country – those are not included in my item prices or shipping fees.

  • Order Confirmation: Once you successfully place an order and payment is received, you should get an order confirmation email. This confirms that I have received your order request. The confirmation does not mark the completion of a contract between us – it is essentially an acknowledgment. The contract of sale is formed when I dispatch the product to you (at which point I’ll send a shipping confirmation). However, rest assured that in almost all cases, once payment is made, I will fulfil the order as agreed, barring any extraordinary circumstance.

4. Order Fulfilment & Shipping

  • Production Time: As detailed in the Shipping Policy, each print is made to order. I aim to produce and dispatch standard orders within a few business days. Limited edition prints might take a little longer (due to signing or special handling). I will let you know if there’s any extended delay.

  • Shipping: I ship orders to the UK and internationally, as described in my Shipping Policy page . Shipping options (standard, express) and costs are clearly presented at checkout. I will do my best to dispatch your order via the method you selected. Delivery estimates are given in working days. Note that these are estimates and not guaranteed delivery dates; once I hand over the package to Royal Mail or the courier, actual delivery time is somewhat out of my control. I am not liable for delays caused by the postal service or courier, but if an unreasonable delay occurs, I will certainly work with you to locate the package or find a solution.

  • Third-Party Fulfilment: Many prints (especially open edition ones) will be shipped directly to you from my trusted lab in the Scotland. This is a seamless process – I handle the order routing, and you’ll receive the package as if it came from me (with my branding or a neutral label). By purchasing, you acknowledge that I may use this third-party service to fulfil your order. I remain responsible for the order’s successful fulfilment. If lab or a courier encounters a problem (e.g., lost package, printing error), I will take responsibility for correcting it for you, as per my Returns/Refunds policy. In short, I won’t pass the buck; I’ll sort it out.

  • International Shipments: If you order from outside the UK, please be aware of your country’s import rules. You will be responsible for any customs duties, taxes, or brokerage fees. I will fill out customs forms accurately (generally marking the item as “photographic art print” with the actual value paid). I cannot mark orders as “gift” or under-declare the value, as that would be unlawful.

  • Failed Delivery: Please ensure the shipping address you provide is correct and complete. I cannot be responsible for packages that are undeliverable due to an incorrect address provided by the customer. If a package is returned to me due to an address issue or because it was unclaimed, I will contact you. We can arrange a re-shipment, but you may need to pay an additional shipping fee for the second delivery attempt. If it was my error (for example, I wrote the wrong address on the label despite you providing the correct one), then I will, of course, cover the re-shipping cost.

5. Returns & Refunds

  • Return Policy Overview: Please refer to my Returns & Refunds Policy page for full details (which is part of these Terms). In summary, because each print is custom-made to your order, I do not generally accept returns or exchanges for change of mind. All sales are final, except in cases of damage, defect, or error.

  • Damaged or Incorrect Orders: If your order arrives damaged or with any issue, you must inform me within a reasonable time (ideally within 14 days of receipt) with details and photos of the problem. I will then offer a solution, typically a replacement print or a refund, as outlined in the Returns Policy. My aim is to resolve any such issues quickly at no additional cost to you.

  • Customer Responsibility: If a return of the physical item is necessary, it’s your responsibility to ensure the item is packaged securely and returned in good condition (aside from the reported issue). However, do not worry – in most damage cases, I do not ask for the item back, and in cases where I do, I will coordinate the return shipping.

  • Order Cancellations: If you need to cancel an order, contact me immediately. If production hasn’t started, I will cancel and refund. If the item has already been printed or shipped, cancellation might not be possible. I will work with you on a case-by-case basis as described in the Returns Policy.

6. Limitation of Liability

I am responsible for delivering a product that matches the description and is of high quality. However, my liability to you is limited in certain ways:

  • Product Issues: Should the product be faulty or not as described, your remedy is either a replacement or a refund, as discussed in the returns section. I will not be liable for minor differences in appearance (for example, slight variations in crop or color due to print process), but I assure you I make every effort for consistency and quality control.

  • Delays or Inability to Fulfil: I will not be liable for any loss arising from delays in delivery or my inability to fulfil your order in a timely manner if the cause is beyond my reasonable control. This can include events like natural disasters, strikes, accidents, war, communication breakdowns, or failure of third-party services (like if the print lab suddenly has a technical failure or couriers are on strike). That said, if such an event occurs, I will communicate with you and do my best to mitigate the situation.

  • Website Use: While I strive to keep the website up and running smoothly, I do not guarantee that your use of our service will be uninterrupted, timely, or error-free. Technical issues or maintenance might make the site unavailable at times. I will not be liable for any inconvenience or loss if the site is down or if there are errors. If you encounter any bugs (like a glitch in the shopping cart), let me know and I’ll address them.

  • No Indirect Damages: To the fullest extent permitted by law, I (Tom Zawadzki) will not be liable for any indirect, incidental, punitive, or consequential damages arising out of or in connection with your use of the site or purchase of products. For example, I am not liable for loss of enjoyment, lost opportunities, or any damages that are not the direct result of something I did wrong. If, for some reason, I am found liable to you, my liability will be limited to at most the total amount you paid for the product and shipping.

  • Consumer Rights: Nothing in these Terms is intended to limit or exclude your statutory rights under UK consumer law or other applicable laws. Some countries do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. Rest assured, I will always honour my legal obligations to you as a consumer.

7. Privacy and Data

Your submission of personal information through the store is governed by my Privacy Policy (see that page for details). By using the site and placing orders, you consent to the collection and use of information as outlined in the Privacy Policy. Key points: I use your info to fulfil orders and will never sell your personal data. I take privacy seriously and implement appropriate security measures.

If you have any privacy-related questions, please contact me as per the Privacy Policy contact info. If you do not agree with how I handle data, please refrain from using the shop.

8. Governing Law & Dispute Resolution

These Terms and any separate agreements whereby I provide you services or products shall be governed by and construed in accordance with the laws of Scotland, United Kingdom (since that is where I operate from) or generally UK law. This choice of law will not deprive you of any consumer protections under the law of your own country if those are mandatorily applicable.

In the event of any dispute or claim arising out of your use of the website or your purchase, I encourage you to contact me first to seek an amicable resolution – I truly value your business and will do my best to resolve any issues fairly. If we cannot resolve the issue between us, any legal proceedings shall be brought in the UK (specifically, courts of Scotland, unless an alternative is required by law).

For EU/EEA customers, if a dispute cannot be resolved, you may be entitled to use the EU Online Dispute Resolution platform (although as of this writing the UK is no longer part of that scheme post-Brexit, it’s still available for cross-border issues).

9. Changes to Terms

I reserve the right to update or modify these Terms and Conditions at any time. If I make changes, I will update the “last updated” date at the bottom of this document. For significant changes, I may also post a notice on the website or notify customers via email. It is your responsibility to check these Terms periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

If you have an active order and a change is made to the Terms that materially affects that order, the terms that were in place at the time of purchase will generally apply to that order.
